Terms and Conditions

These business-to-business terms govern the use of Reparova by workshops and other commercial users. They do not apply to consumers.

Contract and service

The contract is concluded when an authorized representative registers a workshop and accepts these Terms. Reparova provides customer-facing repair-status links, photos, updates, approval requests, and pickup communication. It is a communication service and not an invoicing, accounting, inventory, payment, or workshop-management system.

Accounts and authority

The registering person confirms that they are authorized to act for the workshop. Users must provide accurate information, protect credentials and passkeys, and promptly remove access for people who no longer require it. The workshop is responsible for activity performed through its accounts unless modeleven IT GmbH caused the unauthorized access.

Workshop responsibilities

The workshop is responsible for the lawfulness and accuracy of customer and repair data, required notices and permissions, data minimization, and ensuring internal notes are not published to customers. A license plate is not authentication; workshops must use the secure access controls supplied by Reparova.

Approvals and communications

Reparova records technical approval and decline events. The workshop remains responsible for determining whether additional formal, evidentiary, pricing, or consumer-law requirements apply before treating an event as a binding repair authorization.

Acceptable use

Users must not misuse the service, attempt unauthorized access, upload unlawful or malicious content, infringe third-party rights, circumvent security, or use Reparova for unrelated high-risk processing. modeleven IT GmbH may restrict access where reasonably necessary to protect the service, users, or third parties.

Data protection

The Privacy Notice applies to modeleven IT GmbH’s own processing. For workshop customer data, the Data Processing Agreement forms part of these Terms. The workshop is the controller and modeleven IT GmbH is the processor unless the parties agree otherwise in writing.

Availability and changes

Reparova is provided with reasonable care but uninterrupted availability is not guaranteed. Access may be limited for maintenance, security, legal requirements, or events outside reasonable control. Material changes to these Terms will be communicated in advance; continued use after the effective date constitutes acceptance where legally permitted.

Liability

modeleven IT GmbH is liable without limitation for intent, gross negligence, personal injury, and liability that cannot legally be excluded. For slight negligence, liability is limited to breaches of essential contractual obligations and to damage that was typical and reasonably foreseeable when the contract was concluded. Liability for data loss is limited to the recovery cost that would have arisen with reasonable backups by the workshop.

Term and termination

The contract runs for an indefinite period. Either party may terminate it at any time by email to the other party. The right to terminate immediately for good cause remains unaffected. Data return and deletion follow the Data Processing Agreement and statutory retention duties.

Law and venue

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The competent court in Vienna has exclusive jurisdiction where such an agreement is legally permitted. Mandatory law remains unaffected.
